Small business opportunities

It is the policy of SOPAKCO that small business concerns, particularly those owned and controlled by socially and economically disadvantaged individuals or women, shall have the maximum practicable opportunity to provide goods and services in support of SOPAKCO's contracts. This policy recognizes SOPAKCO's obligation to promote and develop small business firms and bring them into the mainstream of American economic society. It also is promulgated in accordance with the SOPAKCO's strong commitment to the principles of Executive Order 11246 and Public Law 95-507 and their implementing regulations and is designed to assure that SOPAKCO's business practices and procedures are in conformity with them.

SOPAKCO includes clauses entitled "Utilization of Small Business Concerns and Small Disadvantaged Business Concerns" and "Utilization of Women-Owned Small Businesses" in all subcontracts with regard to federal contracts which offer further subcontracting opportunities and requires all such subcontractors (except small business concerns) who receive subcontracts of at least $500,000 or in the case of a construction contract, at least $1,000,000, to adopt a Program similar to the Program herein.

As used herein, the term "small business concern" shall mean a small business as defined pursuant to Section 3 of the Small Business Act and its implementing regulations.

As used herein, the terms "small business concern owned and controlled by socially and economically disadvantaged individuals" and "small disadvantaged business concern" shall mean a small business (i) which is at least 51 percent owned by one or more socially and economically disadvantaged individuals; or in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more socially and economically disadvantaged individuals; and (ii) whose management and daily business operations are controlled by one or more of such individuals.

As used herein, the term "women-owned business" shall mean a small business concern that is at least 51 percent owned by one or more women who are U.S. citizens and who also control and operate the business. "Control" in this context means exercising the power to make policy decisions. "Operate" in this context means being actively involved in the day-to-day management of the business. "Small business concern" in this context means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria and size standards in 13 CFR 121.

In implementing this Policy, the SOPAKCO presumes that socially and economically disadvantaged individuals include Black Americans, Hispanic Americans, Native Americans, Asian-Pacific Americans, Asian-Indian Americans, and any other minorities or any other individuals found to be disadvantaged by the Small Business Administration. SOPAKCO may rely on written representations by bidders as to their status as a small business. Representation by a bidder as a small disadvantaged business, a women-owned business, or HubZone will require written documentation of said status by the Small Business Administration.
